These Terms & Conditions (“Terms”) govern your access to and use of all websites, programs, courses, digital products, memberships, communities, and services (“Services”) operated by Devlin Consulting Services, LLC (“Company,” “we,” “us,” or “our”).

(collectively, the “Sites”).

By accessing the Sites or using our Services, you agree to these Terms. If you do not agree, discontinue use.

1. AGE OF CONSENT

By using the Sites, you confirm that you are at least 18 years of age. We do not knowingly collect information from minors.

2. GENERAL NO-REFUND POLICY

Unless otherwise explicitly stated on the checkout page of a specific product, all sales are final. No refunds will be issued for any digital product, template, course, program, membership, coaching package, or physical product.

We may, at our sole discretion, choose to offer a goodwill refund, credit, or partial refund in exceptional circumstances.

Any such courtesy does not alter or waive our general no-refund policy.

3. PAYMENT PLANS

If you select a payment plan, you agree to:

Complete all payments in full

Maintain updated payment information

Allow automatic retry attempts for failed payments

We reserve the right to:

Suspend or revoke access to Services for missed or failed payments

Turn overdue accounts over to collections

Refuse future purchases or access

Chargebacks

Initiating a chargeback or payment dispute constitutes a breach of these Terms. We may revoke access to all Services and pursue the amount owed.

4. LICENSE TO USE DIGITAL PRODUCTS

Unless otherwise stated on the product page:

Personal Use License (Default)

You receive a non-transferable, non-exclusive license for personal use within your own business only.

You may NOT:

Share, sell, gift, trade, or redistribute digital files

Reproduce or upload files elsewhere

Rebrand, white-label, or claim authorship

Use any part of the product inside your own courses, memberships, workshops, or templates

Sell derivative works based on copyrighted design files

Commercial-Use Exceptions

Some LightBurn files or design templates may include commercial production rights.

If commercial use is permitted, it will be stated clearly on the product page at purchase.

5. INTELLECTUAL PROPERTY

All content on the Sites—including courses, coaching materials, worksheets, videos, templates, PDFs, branding, frameworks, graphics, and written content—is the exclusive property of Devlin Consulting Services, LLC.

You may not copy, reproduce, distribute, modify, upload, share, or create derivative works without written permission.

Violations may result in removal from programs or legal action.

6. COMMUNITY CONDUCT & REMOVAL

By participating in any community (including Mighty Networks, FG Funnels groups, and coaching spaces), you agree to:

Treat others respectfully

Abstain from harassment, hate speech, or abusive conduct

Avoid spamming, pitching, or soliciting other members

Maintain confidentiality of group discussions

We may remove you from any community or program, without refund, if your conduct violates these Terms or disrupts the environment.

We also reserve the right to ban repeat offenders from future offerings.

7. ACCOUNT ACCESS

Sharing login credentials is prohibited.

We may revoke access for:

Excessive logins from multiple IP addresses

Suspicious activity

Unauthorized file sharing

Violation of usage limits

8. COACHING & EDUCATIONAL DISCLAIMERS

Our Services are educational and informational in nature. Nothing provided is legal, financial, therapeutic, medical, or professional advice.

You are responsible for your own decisions and results.

No Guarantees

We do not guarantee:

Income

Sales

Business success

Audience growth

Client acquisition

Any specific outcome

Any examples shared are illustrative only.

9. EARNINGS DISCLAIMER

Any revenue, sales, or business results shared are examples or testimonials. They are not guarantees or predictors of your results.

Your success depends on your own effort, market conditions, business model, and numerous personal factors.

We use third-party providers such as:

PayPal

FG Funnels

Mighty Networks

Flodesk

ConvertKit / Automate & Chill

Google Analytics

Scheduling or CRM platforms

We are not responsible for the privacy practices, data security, or terms of these third-party providers.

11. TERMINATION OF ACCESS

We reserve the right to:

Terminate or suspend your access to any Service

Remove you from programs or communities

Block future purchases

…for violations of these Terms, unpaid balances, or fraudulent behavior.

No refunds will be issued upon termination.

12. MODIFICATIONS

We may update these Terms at any time. The updated version will be posted with a new “Last Updated” date. Continued use of the Sites constitutes acceptance of changes.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for:

Loss of profits

Business interruption

Data loss

Indirect or consequential damages

Actions taken based on your interpretation of our content

Your use of the Sites and Services is at your own risk.

14. GOVERNING LAW

These Terms are governed by the laws of the State of New Jersey.
